Terms of Service
The agreement between you and SetSally governing your use of the service. By creating an account or using SetSally, you agree to these terms.

1. Who this agreement is between
This agreement is between you (the "Customer", "you", "your") and SetSally ("we", "us", "our"). If you are accepting on behalf of a company, you represent that you have authority to bind that company, and "you" refers to that company.
We may also refer to this agreement as "Terms" or "ToS".
2. The service
SetSally provides cloud software for independent auto repair shops to manage bookings, work orders, invoices, customer records, and reminders (the "Service").
A live interactive demo is available at setsally.com/demo. The demo uses mocked data and does not require an account.
3. Your account
To use the Service you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your password secure and not share it
- Notify us promptly at security@setsally.com if you suspect unauthorized access
- Take responsibility for all activity under your account
You must be at least 16 years old (or older if your jurisdiction requires) to use SetSally.
4. Acceptable use
You agree not to:
- Use the Service to break the law or infringe anyone's rights
- Upload viruses, malware, or anything designed to disrupt the Service
- Attempt to access the Service by means other than the interface we provide
- Reverse-engineer, decompile, or extract source code from the Service (to the extent prohibited by law)
- Use the Service to send unsolicited communications (spam) to third parties
- Use the Service to store or process personal data in violation of GDPR, CCPA, or other privacy laws
- Resell the Service without our written permission
- Use the Service in any way that could damage, disable, overburden, or impair our infrastructure
We may suspend or terminate access if we reasonably believe you are violating this section.
5. Your data and privacy
Our Privacy Policy explains what data we collect, why, how we protect it, and the rights you have under GDPR, CCPA, and other privacy laws. By using the Service you agree to that policy.
You retain all rights to the data you upload to SetSally. We claim no ownership over your customer records, invoices, or other workspace content.
6. Billing, fees, and free trial
Some features are offered for free; others require a paid plan. Prices and plan limits are listed on our pricing page.
- Free trial: if offered, no charge during the trial. You can cancel any time during the trial to avoid being charged.
- Subscription: recurring, billed in advance per the plan you select (monthly or annual). Payments are processed by Stripe.
- Price changes: we may change prices with at least 30 days' notice. Existing subscriptions continue at the old price until the end of the current billing period.
- Taxes: prices are exclusive of VAT, GST, sales tax, and other applicable taxes unless stated otherwise. You are responsible for paying these.
- Refunds: except where required by EU consumer law (14-day right of withdrawal for natural persons), fees are non-refundable. We may issue pro-rated refunds at our discretion.
7. Intellectual property
The Service, its design, code, trademarks, and content (other than your data) are owned by SetSally and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
Feedback you give us (suggestions, ideas) is not confidential — we may use it without restriction.
8. Third-party services
SetSally integrates with third-party services (Stripe, Clerk, Resend, Supabase, and others listed in our Privacy Policy). We are not responsible for the availability, accuracy, or content of those services. Your use of them is governed by their own terms.
9. Beta features
We may offer features marked "beta", "preview", or "experimental". These are provided as-is, may change without notice, and may not be as reliable as the rest of the Service.
10. Termination
By you: you can cancel your subscription at any time from your billing settings. We will keep your data for 30 days after cancellation in case you change your mind, then permanently delete it.
By us: we may suspend or terminate the Service if you breach these Terms, fail to pay, or if we are required to do so by law. For non-material breaches we will give you 14 days to cure.
Effect of termination: your right to use the Service ends. Clauses that by their nature should survive (payment, liability, dispute resolution) will survive.
11. Service level and availability
We aim for 99.9% monthly uptime but do not guarantee uninterrupted access. We may perform maintenance with or without notice. Where paid plans include an SLA, the SLA terms control.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.
- Our total aggregate liability for any claim arising out of or relating to the Service is capped at the greater of (a) the fees you paid us in the 12 months before the claim or (b) €100.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).
13. Indemnification
You agree to indemnify and hold SetSally harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
14. EU consumer rights
The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged and do not commit to use it.
15. Disputes and governing law
These Terms are governed by the laws of Ireland, without regard to its conflict-of-laws rules.
If you are a consumer based in the EU, you also benefit from the mandatory consumer protection laws of your country of residence.
We will try to resolve disputes informally first — email legal@setsally.com. If we cannot resolve a dispute within 60 days, either party may bring proceedings in the courts of Ireland, except that consumers may also bring proceedings in the courts of their country of residence.
16. Changes to these terms
We may update these Terms. For material changes we will notify you by email and in-product at least 30 days before they take effect. Continuing to use the Service after the effective date constitutes acceptance. If you do not agree, you may cancel before the effective date.
